Public offer

1. General provisions

1.1. This document is a public offer of Khizmatrasonii Nav Limited Liability Company (the “Provider”) and contains all essential terms of the agreement for listing information about websites in the catalog.tj ranking and catalog at https://catalog.tj (the “Site”).

1.2. The offer is addressed to any legally capable individual, individual entrepreneur or legal entity (the “Customer”) and is made in accordance with the Civil Code of the Republic of Tajikistan.

1.3. Payment for the selected service on the Site constitutes acceptance of this offer. From the moment the payment is confirmed, the agreement is concluded on the terms of this offer without signing a separate document.

1.4. Matters not covered by the offer are governed by the legislation of the Republic of Tajikistan, including the Laws of the Republic of Tajikistan “On Consumer Rights Protection”, “On Advertising” and “On Personal Data Protection”.

1.5. The Terms of Use and the Privacy Policy published on the Site are an integral part of this offer.

2. Definitions

• “Listing” — display of information about the Customer’s website (domain, name, description, category) in the Site’s ranking.
• “Bid” — the amount in somoni paid by the Customer for a paid listing; it determines the listing’s position within a section.
• “General section” — the permanent ranking of the Site.
• “Today section” — the ranking of 24-hour listings.
• “Sponsor block (VIP)” — the block displayed above all rankings of the Site.
• “Account” — the area of the Site available to the Customer after signing in.

3. Subject of the agreement and tariffs

3.1. The Provider undertakes, for a fee, to list (promote) information about a website from the Site’s catalog in the selected section of the Site for the term of the selected tariff, and the Customer undertakes to pay for the service. The Customer may be the website owner or any other person.

3.2. Tariffs:

• “Paid · General” — a permanent listing in the General section for a one-off payment. The listing remains active while the Site operates and until it is removed on the grounds set out in this offer.
• “Paid · Today” — a listing in the Today section for 24 hours from payment confirmation, regardless of the time of day: a listing paid at 23:59 stays active until 23:59 the next day.
• “Sponsor / VIP” — a listing in the sponsor block above all rankings for 7 days from payment confirmation, with a “VIP” label and a highlighted frame. The number of places in the block is limited; if no places are free, orders for this tariff are unavailable.

3.3. Free listing is not the subject of this agreement and is governed by the Terms of Use.

3.4. Minimum tariff amounts and the bid step are shown on the Site and in the Account in somoni and apply at the time the order is placed. Changes to minimum amounts do not affect listings that have already been paid for.

3.5. Paid listings are advertising and are marked as paid (sponsored). Links to websites from paid listings are marked as sponsored for search engines.

4. How the position is determined

4.1. Within a section, a listing’s position is determined by the bid: the higher the bid, the higher the position. With equal bids, the listing paid earlier (by payment confirmation time) ranks higher.

4.2. The Customer may raise the bid of an active listing. Top-ups are added to the bid.

4.3. The position may change as a result of payments by other customers. The Provider does not guarantee any particular place, number of clicks, traffic or other commercial results.

4.4. Paid listings are placed above free ones. The sponsor block is placed above all sections; the order within the block is also determined by the bid.

5. Placing an order and payment

5.1. To order a paid listing, the Customer signs in to their account on the Site and chooses a website from the catalog — their own or any other. A paid listing can be ordered only for a website that has passed moderation and is published.

5.2. The Customer selects a tariff and an amount not lower than the minimum and creates an order. An unpaid order is cancelled 30 minutes after it is created.

5.3. Payment is made in somoni through the payment service indicated on the Site (the SmartPay payment aggregator and the e-wallets and banking apps connected to it). Bank card and payment instrument data are processed by the payment service; the Provider neither receives nor stores them.

5.4. The service is deemed paid from the moment the Provider receives confirmation of a successful payment from the payment service. The listing term starts at that moment.

5.5. The Provider issues the Customer a document confirming payment in the manner established by the tax legislation of the Republic of Tajikistan. Legal entities receive an invoice and closing documents on request.

5.6. Fees of banks and payment services, if charged to the Customer, are paid by the Customer.

6. Extension and raising the bid

6.1. “Paid · Today” and “Sponsor / VIP” listings can be extended from the Account before the term ends or within 72 hours after it ends.

6.2. An extension is paid at the listing’s current bid, but not lower than the tariff minimum. The new term is added to the end date of the current term; if the term has already expired, it runs from the confirmation of the extension payment.

6.3. Raising the bid applies until the end of the current listing term and does not extend it.

6.4. Payment and expiry dates and times are shown in the Account in Dushanbe time (UTC+5).

7. Website requirements and moderation

7.1. Websites whose content violates the legislation of the Republic of Tajikistan may not be listed, including websites with gambling, adult (18+) content, extremist or terrorist materials, phishing or malware, as well as websites that infringe third-party rights or to which the Customer has no rights.

7.2. The Provider may review websites before and after publication, request proof of rights, and reject, remove or block a listing in case of a violation. Moderation decisions are shown in the Account.

7.3. If a listing is removed because the Customer artificially inflated clicks or otherwise broke the fair ranking rules, the amount paid is not refunded. If the website is removed on the grounds of clause 7.1, the Provider refunds the cost of the unused listing term, unless the Customer is the owner of that website.

7.4. The Provider automatically checks every day that websites are reachable. A website that does not open, or whose domain does not exist (was cancelled), in three checks in a row is hidden from the catalog and returns automatically once it works again. The paid listing term is neither suspended nor extended for that time.

7.5. The owner of a website on the Site is the person who added the domain first. Ownership passes to another person only upon a written request to info@hizmatrason.tj with proof of rights to the domain; support makes the decision within 72 hours of the request. Paid listings stay with the domain.

8. Refunds

8.1. If the payment was charged but the listing was not activated for reasons attributable to the Provider, the Provider, at the Customer’s choice, activates the listing or refunds the amount in full.

8.2. If the paid service is interrupted through the Provider’s fault for more than 24 consecutive hours, the Provider extends the listing by the length of the interruption or refunds the cost of the unused term pro rata.

8.3. A Customer who is a consumer may withdraw from the agreement at any time, provided they pay the Provider for the services actually rendered. For the “Paid · Today” and “Sponsor / VIP” tariffs, the cost of services rendered is calculated pro rata to the elapsed listing term; the “Paid · General” service is deemed fully rendered when the listing is activated.

8.4. A refund request is sent to info@hizmatrason.tj stating the order number. It is reviewed within 10 business days. The refund is made by the same method used for payment unless the parties agree otherwise.

9. Rights and obligations of the parties

9.1. The Provider shall provide the listing in accordance with the paid tariff and show listing terms and payment history in the Account.

9.2. The Provider may change the design and the way the ranking is displayed without worsening the terms of paid listings, carry out maintenance, and suspend a listing if the Customer breaches the offer.

9.3. The Customer shall provide accurate information about the website, comply with section 7 and not interfere with the click counters.

9.4. The Customer acts as the advertiser for the paid listing. The website owner is responsible for the website’s content.

10. Liability

10.1. The Provider’s liability under the agreement is limited to the amount paid by the Customer for the relevant listing.

10.2. The Provider is not liable for the operation of the Customer’s website, communication networks, payment services or other third parties, or for the Customer’s lost profits.

10.3. The parties are released from liability for failure to perform due to force majeure (natural disasters, military actions, acts of public authorities, large-scale communication outages, etc.).

11. Changes to the offer

11.1. The Provider may amend the offer by publishing a new version on the Site. The new version applies to orders placed after its publication; the terms of listings already paid for remain in force until their term ends.

12. Dispute resolution

12.1. Disputes are settled through negotiations. A claim is sent to info@hizmatrason.tj; the response time is 10 business days.

12.2. If no agreement is reached, the dispute is heard by a court of the Republic of Tajikistan in accordance with the rules of jurisdiction, taking consumer rights into account.

12.3. The offer is published in Tajik, Russian and English. In case of discrepancies, the Russian version prevails.
